A copyright dispute before the United States Supreme Court, involving artwork by the late pop art icon Andy Warhol, is attracting attention around the world. Professor David Tan, Co-Director of the Centre for Technology, Robotics, Artificial Intelligence and the Law at the NUS Faculty of Law, opines that the Supreme Court needs to clarify the fair use test to strike the right balance between enabling creators to monetise their works and encouraging new art to flourish in dialogue with existing art.
